Terms and Conditions
By engaging Out Of The Box Assembly for services, you agree to the following terms and conditions:
1. Scope of Services:
We provide flatpack furniture assembly and a range of related services, including TV mounting, picture hanging, shelf mounting, and other services as detailed in the quotation or booking.
2. Quotations and Bookings:
All quotations are valid for 7 days from the date issued (Unless otherwise specafied). Bookings are confirmed upon your acceptance of the quotation, either verbally or in writing, and may require a deposit for larger jobs, as specified in the quotation.
3. Payment:
Payment is due upon completion of the service. We accept cash and bank transfer. For larger jobs ($800 and more), a deposit of 20% may be required upon booking, with the remaining balance due upon completion. Payments not received within 3 days following the completion date may incur a late fee of 10% per 24-hour period on the outstanding balance unless a payment plan has been agreed upon and is in place.
All attendances will incur a basic service fee, plus the equivalent of one hour's work charged at our standard rate. Any additional time past this first hour will ensue extra costs.
4. Customer Responsibilities:
The customer is responsible for providing a clear, clean, and safe working environment suitable for furniture assembly. The customer is also responsible for ensuring that all flatpack furniture and components are present at the service location prior to our arrival. If the assembly area does not meet these requirements, we reserve the right to either apply an additional fee to cover the necessary preparation work, which will be discussed with you on-site, or to refuse to commence the work. If we refuse to commence work due to an unsuitable environment, a call-out fee or a portion of the quoted price may be payable by the customer to cover our time and travel. For TV mounting, picture hanging, and shelf mounting, the customer warrants that the walls are of suitable structure and integrity to support the items being mounted. We will use standard mounting techniques and hardware appropriate for common wall types, but the ultimate responsibility for the wall's capacity to hold the mounted items safely rests with the customer.
5. Damaged or Missing Parts:
Our service focuses on the assembly of flatpack furniture. The customer should inspect the packaging upon delivery for any external damage. It is the customer's responsibility to ensure all parts are present and undamaged prior to our service. Due to previous issues in supply and manufacturing, our assemblers always check the parts count and hardware before assembly but are not always able to identify defects before starting assembly. If, upon our arrival or during assembly, damage or missing parts are discovered, these are the responsibility of the customer to resolve with the retailer. Please be aware that assembling furniture with missing or damaged parts may affect the retailer's return policy, often requiring the return of the complete unit.
If, during assembly, we encounter missing parts that prevent completion, the quoted assembly fee will apply for the time spent. We may, at our discretion, offer solutions using alternative hardware or methods to complete the assembly. However, if we do so at your request, any liability for the suitability or longevity of these alternative solutions rests solely with the customer. We are not responsible for obtaining original replacement parts; this remains the customer's responsibility with the retailer/manufacturer.
While the manufacturer holds sole responsibility for parts that are damaged or unsuitable for assembly, the customer remains responsible for paying the assembly service for any work. The customer must then seek reimbursement or resolution directly from the manufacturer.
6. Cancellation or Rescheduling:
Cancellations or rescheduling with less than 24 hours' notice may incur a cancellation fee starting from $100 to cover incurred costs, including travel. We understand that unforeseen circumstances can arise, and we will consider these on a case-by-case basis.
7. Limitation of Liability:
To the maximum extent permitted by law, our liability for any loss or damage arising from our services, whether in contract, tort (including negligence), or otherwise, shall be limited to the total fees paid by you for the specific services in question. We shall not be liable for any indirect, incidental, special, or consequential damages.
8. Governing Law:
These terms and conditions shall be governed by and construed in accordance with the laws of the State of Victoria, Australia. Any disputes arising under or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Victoria.
